MOTION FOR AN EUROPEAN PARLIAMENT RESOLUTION

pursuant to Rule 115 of the Rules of Procedure, by

the undersigned Swedish Members of the European Parliament, and others

The European Parliament,

- having regard to the Treaties of the European Union

- having regard to the Rules of Procedure of the European Parliament

A. whereas it is not permissible for the European Parliament to commment on legal procedures in a Member State, pre-empting their outcome.

B. whereas activity which is subject to a court trial in a Member State cannot be judged by the European Parliament

1. calls on the President of the European Parliament to suspend the decision of the Conference of Presidents to vote on the report "On the outlook for copyright in the EU" (A6-0017/2009, 2008/2121(INI)) until the final verdict in the case B 13301-06 (The Pirate Bay vs. Warner et al.) has been concluded.

The swedish constitution "regeringsformen" refers to the principle of division of powers in the following way:

No public authority, including the Riksdag and the decision-making bodies of local authorities, may determine how an administrative authority shall decide in a particular case relating to the exercise of public authority vis-à-vis a private subject or a local authority, or relating to the application of law.
